1. OVERVIEW

Welcome to Concierge Wellness, LLC (“Concierge Wellness,” “Company,” “we,” “us,” or “our”). Concierge Wellness is a California-registered wellness services company that facilitates access to wellness programs, telehealth consultations, prescription-based treatments, and related products and services through independent healthcare providers and third-party service partners. By accessing our website, purchasing products, enrolling in a wellness program, or utilizing our services, you agree to these Terms of Service. Our offerings may include medical weight management, GLP-1 treatments, peptide therapies, hormone-related wellness programs, nutritional supplements, and other health and wellness services. All medical evaluations, diagnoses, treatment recommendations, and prescriptions are provided exclusively by appropriately licensed healthcare professionals affiliated with independent medical practices. Concierge Wellness does not practice medicine, diagnose medical conditions, prescribe medications, or make clinical treatment decisions.

2. MEDICAL SERVICES DISCLAIMER

Concierge Wellness coordinates access to healthcare services through independent, licensed medical providers. All medical evaluations, diagnoses, treatment recommendations, prescriptions, and clinical decisions are made solely by the treating healthcare professional. Information provided through our website, customer service representatives, wellness coordinators, or other nonclinical personnel is intended for general educational and informational purposes and does not constitute medical advice. Such information does not replace an individualized medical evaluation or establish a provider-patient relationship. A provider-patient relationship may be established only through an independent medical practice and its licensed healthcare professionals in accordance with applicable law. Concierge Wellness does not direct, supervise, or interfere with the independent medical judgment of healthcare providers.

3. TELEHEALTH SERVICES

Medical services facilitated through Concierge Wellness may be delivered through telehealth platforms operated by independent medical practices or their authorized service providers. Telehealth services may include live video consultations, telephone consultations where permitted, electronic medical questionnaires, asynchronous medical evaluations, and electronic communications with healthcare professionals. The treating medical provider determines whether telehealth is appropriate for an individual patient and whether an in-person evaluation is necessary. By requesting telehealth services, you acknowledge that telehealth has limitations and that certain medical conditions may require in-person evaluation or treatment. Any legally required telehealth informed consent will be obtained separately by the medical practice or healthcare provider. Telehealth services are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or seek immediate emergency medical care.

4. PRESCRIPTION MEDICATIONS AND TREATMENT ELIGIBILITY

Prescription medications are available only when an appropriately licensed healthcare provider determines that treatment is medically appropriate. Completing a medical questionnaire, submitting payment, or enrolling in a wellness program does not guarantee that a prescription will be issued. All prescribing decisions are made independently by licensed medical professionals. Healthcare providers may decline to prescribe a requested medication, recommend alternative treatment, require additional medical information or laboratory testing, modify or discontinue treatment, or require follow-up consultations. Concierge Wellness does not guarantee access to any specific medication, dosage, or treatment protocol. Patients are responsible for providing accurate and complete medical information, including current medications, allergies, medical conditions, and relevant medical history.

5. COMPOUNDED MEDICATIONS

Certain treatments coordinated through Concierge Wellness may involve compounded prescription medications when prescribed by an authorized healthcare professional. Compounded medications are not FDA-approved and have not undergone FDA premarket review for safety, effectiveness, or quality. A compounded medication is not equivalent to an FDA-approved medication simply because it contains an ingredient also found in an FDA-approved product. The treating healthcare provider determines whether a compounded medication is clinically appropriate and legally available for an individual patient. Compounded medications are dispensed by appropriately licensed pharmacies in accordance with applicable federal and state laws. Concierge Wellness does not manufacture, compound, prescribe, or dispense medications. Availability of compounded medications may change due to regulatory requirements, pharmacy availability, or clinical considerations.

6. THIRD-PARTY PHARMACY FULFILLMENT

Prescription medications are dispensed and fulfilled by independent, appropriately licensed pharmacies. Concierge Wellness does not manufacture, compound, package, or directly dispense prescription medications. Pharmacies and shipping carriers are independently responsible for their respective dispensing, packaging, and delivery activities. Delivery timelines may vary based on prescription processing, pharmacy operations, inventory, shipping carriers, weather conditions, and other circumstances. Concierge Wellness cannot guarantee specific delivery dates. Customers are responsible for providing accurate shipping information and following medication storage and handling instructions supplied by the dispensing pharmacy. If a shipment is delayed, damaged, lost, or delivered incorrectly, Concierge Wellness will make reasonable efforts to assist with communication and resolution. Nothing in these Terms limits any rights or remedies available to patients under applicable law.

7. PAYMENTS, MEMBERSHIPS, AND BILLING

By purchasing products, enrolling in a wellness program, or authorizing payment, you agree to pay the applicable fees disclosed at the time of purchase. Depending on the program selected, fees may include administrative services, wellness coordination, medical consultations provided by independent healthcare practices, prescription medications dispensed by third-party pharmacies, membership or subscription fees, and laboratory testing. The entity responsible for charging each fee, the services included, and any applicable recurring billing terms will be disclosed before purchase. Certain programs may involve recurring monthly payments. By enrolling in a recurring subscription or membership, you authorize the applicable disclosed charges according to the billing terms presented during enrollment. Recurring billing disclosures will identify the amount or calculation method, billing frequency, cancellation procedure, and other information required by applicable law. Enrollment in a wellness program does not guarantee prescription approval or continued eligibility for treatment.

8. REFUNDS AND CANCELLATIONS

Refund eligibility depends on the specific product or service purchased, whether services have been performed, whether medications have been dispensed, and applicable law. Program-specific refund and cancellation conditions will be disclosed before purchase. Prescription medications that have already been dispensed or shipped may be ineligible for return or refund, subject to applicable law and pharmacy policies. Customers may request cancellation of future services or recurring payments through the cancellation methods provided at enrollment. For customer assistance, cancellation requests may also be directed to info@sdconciergewellness.com. Cancellation of a membership or recurring payment arrangement does not automatically terminate an established provider-patient relationship or replace the need for appropriate medical follow-up. Cancellation does not automatically reverse charges for services already performed or products already fulfilled. Concierge Wellness will comply with applicable consumer protection laws and legally required refund and cancellation rights.

9. NO GUARANTEED RESULTS

Individual responses to medical and wellness treatments vary. Results may depend on medical history, treatment adherence, lifestyle, nutrition, physical activity, underlying health conditions, and individual biological factors. Concierge Wellness makes no guarantees regarding weight loss, weight management outcomes, hormonal changes, energy levels, metabolism, physical performance, cosmetic improvements, treatment effectiveness, or eligibility for prescription medications. Testimonials, customer experiences, and educational materials should not be interpreted as guarantees of individual results.

10. PATIENT RESPONSIBILITIES

Patients and customers agree to provide truthful, accurate, and complete information. Patients must disclose relevant medical history, medications, allergies, and medical conditions to their treating healthcare providers. Prescription medications must be used only as directed by the prescribing healthcare professional. Patients must not share, resell, or transfer prescription medications. Patients are responsible for notifying their healthcare providers of adverse reactions or significant health changes. Misrepresentation, fraudulent activity, medication diversion, or other prohibited conduct may result in suspension or termination of access to Concierge Wellness services. Any decision to terminate ongoing medical care remains subject to the independent medical practice’s professional obligations and applicable law.

11. INDEPENDENT MEDICAL PROVIDERS

Concierge Wellness maintains relationships with independent medical practices and third-party service providers to facilitate access to wellness and healthcare services. These medical practices retain independent authority over all clinical decisions. Concierge Wellness does not guarantee that a particular provider will be available or that a provider will recommend or approve any specific treatment. The medical practice and treating healthcare professional remain responsible for their own professional services, subject to applicable law. Nothing in these Terms is intended to waive patient rights or eliminate the legal responsibilities of any healthcare provider.

12. PRIVACY AND CONFIDENTIALITY

Concierge Wellness respects the privacy and confidentiality of customer and patient information. Personal information is collected, used, maintained, and disclosed in accordance with applicable privacy laws and our Privacy Policy. Medical information maintained by independent healthcare providers may also be subject to HIPAA and other applicable healthcare privacy laws. Concierge Wellness and its medical practice partners may have different legal obligations concerning the information each entity maintains. Patients should review the applicable medical practice’s Notice of Privacy Practices and any required privacy authorizations.

13. AVAILABILITY AND GEOGRAPHIC RESTRICTIONS

Concierge Wellness, LLC is registered in California and facilitates access to services for eligible customers throughout the United States. Medical services are available only in jurisdictions where appropriately licensed healthcare professionals are legally authorized to provide care. Treatment eligibility, prescription availability, telehealth requirements, and pharmacy fulfillment options may vary by state. Accessing the Concierge Wellness website does not guarantee that medical services or medications are available in a particular jurisdiction. Patients may be required to verify their physical location at the time of a medical consultation. Concierge Wellness reserves the right to restrict or discontinue access to services in jurisdictions where such services are unavailable or prohibited by applicable law.

14. WEBSITE CONTENT AND INTELLECTUAL PROPERTY

All original website content, branding, graphics, educational materials, and other proprietary materials belonging to Concierge Wellness are protected by applicable intellectual property laws. Content may not be reproduced, distributed, modified, or used commercially without prior written authorization, except as otherwise permitted by law. 15. LIMITATION OF LIABILITY

Nothing in these Terms limits a healthcare professional’s responsibility for medical care, professional negligence, or other obligations imposed by applicable law.

16. MODIFICATIONS TO SERVICES AND POLICIES

Concierge Wellness reserves the right to modify its website, administrative services, available wellness programs, and these Terms of Service, subject to applicable law. Changes may be necessary due to business operations, regulatory developments, medical practice requirements, or pharmacy availability. Material changes affecting existing customers will be communicated when required by law. Changes to recurring billing arrangements will be handled in accordance with applicable consumer protection requirements.

17. GOVERNING LAW

These Terms of Service are governed by the laws of the State of California, without regard to conflict-of-law principles, except where otherwise required by applicable law. Nothing in this section limits consumer rights or legal protections that cannot be waived.
